Brain Alarm Privacy Policy
This policy explains how the provider ("us" or "we") of the "Brain Alarm" mobile application (the "App"), collects Personal Data (as that term is defined below), and what your rights are in relation to it.
Please read this Privacy Policy carefully, so that you can understand our practices and your rights in relation to your Personal Data.
In this Policy, "Personal Data" means any information relating to an identified or identifiable natural person, or as that term is otherwise defined under applicable privacy laws.
This Policy can be updated from time to time and we therefore ask you to check back periodically for the latest version (as stated above under "Last Updated"). If we implement significant changes to the use of your Personal Data in a manner different from that stated at the time of collection, we will notify you by posting a notice on our website, available at brainalarm.randomizeteam.com (the "Website"), or in the App.
In Short
We do not operate user accounts, we run no servers that receive data from the App, and we use no analytics, advertising or tracking services in the App or on our Website. The App does not request internet access permission, and information it holds (such as alarms, timers, puzzle history, settings and any audio files you add) is stored locally on your device, where we cannot reach it.
This is deliberate. Keeping your information local on your device is how we protect your data.
There is one situation where your Personal Data reaches us, and it is when you send it deliberately. If you use the App's "Send Feedback" option, your message reaches us from your email application. For further information, please read below.
What Information We Collect when you send us feedback and how we use it
Contacting us is entirely voluntary. The App includes a "Send Feedback" option, which allows you to send us an email. When you choose to do so, we receive your email address, the display name configured in your email application, and any other information you choose to provide us. We encourage you not to send us any further personal details or Personal Data.
When you send us an email, we use what you send us on the following legal bases:
- to reply to you, to diagnose and fix any problem you describe, and to consider any improvements you suggest (Legitimate Interest — our interest in being able to answer people who write to us and to keep the App working correctly);
- to comply with legal obligations that apply to us (Legal Obligation).
Please do not send us sensitive details. We do not need, and ask you not to include, sensitive information about you, including information about your health, religious or philosophical beliefs, political opinions or sexual orientation.
Disclosure of Your Personal Data
We do not sell or trade Personal Data. When you use the "Send Feedback" option, your Personal Data is disclosed to our email provider, and may be disclosed to: (a) our lawyers and other professional advisers; (b) in exceptional circumstances, to governmental or law enforcement officials, in response to a subpoena, search warrant or court order (or similar requirement) or in compliance with applicable laws; and (c) an acquirer, if we or the App is sold, transferred or merged, as part of that transaction.
Transfer of Personal Data
When you use the "Send Feedback" option, the content of your email may be held in countries different than the one from which you sent it. In this case, the transfer of your data is made in accordance with the provisions of the applicable privacy legislation that safeguard your Personal Data.
Data Security
The App operates locally on your device, and data you enter into the App is not accessible to us. Additionally, the mailbox that receives your email (when you send us an email using the "Send Feedback" option) is protected by the security measures of our email provider, together with strong authentication and access limited to those who need it in order to answer you.
Data Retention
If you send us an email via the "Send Feedback" option, we retain the Personal Data contained in the email for as long as necessary to reply to you and resolve your request. We retain it for longer only where we are required to do so by law, or where it is necessary for the establishment, exercise or defense of legal claims, and in that case only for as long as that purpose requires. We hold no other Personal Data.
Use by Children
The App is not directed at children. The minimum age for using the App is 13, as stated in our Terms of Service, available at Terms, and we do not knowingly collect Personal Data from anyone below that age.
If we become aware that we have received Personal Data from a child in circumstances that applicable law does not permit, we will delete it as quickly as possible. If you are a parent or guardian and you believe that a child has sent us Personal Data, please contact us at [email protected] and we will remove it as quickly as possible.
Android's Auto Backup
Android operates a backup feature to your personal Google Account. If backup is switched on for your device, Android backs up the App's basic settings and any audio files you have added to the App to your Google Account (which allows you a better experience, like restoring when you reinstall the App or set up a new device). We have no access to the backup, and it is governed by Google's Privacy Policy. You can review or switch off backup in your device settings.
Your Privacy Rights
Subject to the conditions and exemptions in applicable law, and to the extent applicable to you under the laws of your country, you have the following rights in relation to Personal Data we hold about you:
- to be told whether we hold Personal Data about you and, if so, to receive a copy of it.
- to have inaccurate Personal Data about you corrected and incomplete data completed.
- to have your Personal Data deleted, where appropriate grounds apply in accordance with the law.
- to have our use of your Personal Data limited, in the circumstances the law provides for.
- where we rely on our legitimate interests, to object to our use of your Personal Data on grounds relating to your particular situation, unless we can demonstrate legitimate grounds and subject to the law.
- to receive the Personal Data you provided us in a portable format.
If you wish to exercise any of these rights, contact us at [email protected]. We may ask for additional information (including to confirm your identity) before acting on your request.
Please note that these rights are not absolute and are subject to the exemptions set out in applicable law.
If you wish to raise a complaint about how we handle your Personal Data, please contact us at [email protected]. If you are not satisfied with our response, or believe we are collecting or processing your Personal Data otherwise than in accordance with applicable law, you can lodge a complaint with the data protection supervisory authority in the country where you live.
